Serghei Comerzan's lawyers request reprimand of Audrain County Prosecutor

The attorneys for a man accused in the death of a state trooper have asked a judge to reprimand Audrain County Prosecutor, Jacob Shellabarger.

John James, Serghei Comerzan's attorney, confirmed Thursday night the request is related to an altercation following closing arguments in last week's trial.

Court records show Comerzan's attorneys filed a motion Thursday for the reprimand, along with an objection to the prosecutor's request to keep them from speaking about the case publicly.

James said Thursday night he didn't think it was appropriate to say too much until a judge rules on the prosecutor's request. He confirmed the defense requested a judgement of acquittal earlier this week based on the facts and evidence presented during trial.

A Saint Charles County jury last week couldn't decide whether to convict 22-year-old Comerzan of second degree murder and resisting a lawful stop in the death of TrooperJames Bava. Prosecutors said Bava was trying to pull over speeding motorcyclist, Comerzan, in August of 2015 in Audrain County. The defense maintained the state doesn't have enough evidence to prove Comerzan knew Bava was trying to pull him over.

KRCG13 called the Audrain County Prosecutor's office for comment, but that call had not been returned as of Thursday night.

A Saint Charles County clerk said Thursday all motions in the case are sealed.

A judge is set to rule on the motions June 15.
