Second trial date set for Serghei Comerzan
ST. CHARLES —
Serghei Comerzan will go to trial a second time for charges in the death of a state trooper in February of 2018.
A second jury will try to decide if Comerzan is guilty of second degree murder and resisting a lawful stop in the 2015 death of Trooper James Bava.
The trial is scheduled to begin February 23rd at 9 a.m. Like Comerzan's first trial, the upcoming trial is expected to last six days.
Comerzan's new trial date comes after the first jury in Saint Charles County court couldn't decide whether to convict the 22-year-old.
Comerzan's attorneys, Charles and John James, argued the state doesn't have enough evidence to prove their client knew Bava was trying to pursue him.
The state argues Comerzan, who was speeding more than 100 mph on his motorcycle, knew or reasonably had to know Bava was trying to pull him over after the two passed each other over a hill crest on state road FF.
