The prime suspect in a 2011 Cole County murder case was released from jail Tuesday after the prosecutor dropped the charge.

Jose Hurtado was charged with second-degree murder in the December 2011 shooting death of Francisco Navarro. The shooting occurred in the Apache Flatts mobile home park.

Prosecutor Mark Richardson said it was a "witness issue" that hurt his case. He added that he will review the case to see if charges will be re-filed later.

Cole County Sheriff Greg White expressed concern over the turn of events, but said he was legally bound to release Hurtado.
