Gov. Jay Nixon and Missouri's attorney general say the governor shouldn't have to testify in a Chillicothe man's murder retrial.
Attorney General Chris Koster filed a motion for a protective order Monday asking a judge to block a defense request for Nixon's testimony in the Mark Woodworth case.
Nixon was attorney general when then-special state prosecutor Kenny Hulshof was appointed to the Woodworth case two decades ago.
Woodworth's 1995 conviction for the shooting death of neighbor Cathy Robertson was overturned on appeal. He was convicted again four years later and sentenced to life in prison. The Missouri Supreme Court overturned that conviction in January.
Koster argues that Nixon doesn't have any relevant information in the case. A hearing on the request is schedule for Thursday.
